Registering a trade mark with the Patent Office of the Republic of Poland in one class costs approximately PLN 890 in official fees in total: the application costs PLN 400 online or PLN 450 on paper, followed after approval by fees for 10 years of protection and publication. A trade mark protects a company’s name or logo against someone else using a similar sign for the same goods or services. The registration cost consists of several items paid at different times: official fees, an optional patent attorney’s fee and, often, the cost of designing a logo. We break down each of them based on the price lists and fees collected in our index.

How much does it cost to register a trade mark with the Patent Office?

Registering a trade mark in one class with the Patent Office of the Republic of Poland costs approximately PLN 890 in official fees in total. This amount consists of three fees, paid at two separate times:

  1. Application fee, paid when submitting the application: PLN 400 for an electronic application and PLN 450 for a paper application.
  2. Fee for the first 10‑year protection period, paid only after the office approves the application.
  3. Publication fee for publishing information about the protection right granted, paid together with the protection fee.

Official fees are the same throughout Poland because they are set by regulation. Details and sources are available on the trade mark registration page. If the office refuses registration, the application fee is not refunded, but the protection and publication fees are not payable.

Each additional class of goods or services in the same application incurs an extra fee that is not included in the amount of PLN 890. Before applying, it is therefore worth considering which classes the company actually operates in instead of listing them all just in case.

How much does a patent attorney charge for a trade mark application?

According to price lists, the fee charged by a patent attorney or law firm for handling a trade mark application is approximately PLN 1,250 and is payable in addition to the official fees. For this price, the patent attorney will usually check whether a similar mark has already been registered, select classes under the Nice Classification, prepare the list of goods and services and submit the application.

Do you need a patent attorney? Business owners can submit their own applications, and the online form is available to everyone. A patent attorney is worthwhile when:

  • the name resembles a well-known brand and there is a risk of opposition,
  • the company operates in several industries and selecting the classes is difficult,
  • the mark will subsequently be registered abroad,
  • you do not want to respond to correspondence from the office yourself during the proceedings.

Protecting a logo through the UPRP costs the same as protecting the name alone, approximately PLN 890 in official fees for one class. The difference lies elsewhere: the logo must first be designed. According to price lists, a basic graphic design (logo, poster, leaflet) package costs approximately PLN 600, while an extended package with several concepts and full rights costs approximately PLN 5,600.

When registering a logo as a trade mark, pay attention to copyright. The cheapest graphic design packages often do not transfer all economic rights, and without them it is difficult to defend the mark. The agreement with the graphic designer should list the permitted uses, including registration as a trade mark.

A common choice is to register a word mark (the name alone, in any typeface), as this protects the name regardless of how the logo changes. A figurative mark containing word elements protects its specific appearance. Some companies register both, which means two applications and twice the fees.

How long does trade mark registration take?

Registering a trade mark with the UPRP usually takes between several months and more than a year from application to decision. The process is as follows:

  1. Application and fee. The filing date establishes priority, so from that date the mark takes precedence over similar marks filed later.
  2. Examination of formal requirements and absolute grounds for refusal. The office checks whether the mark is distinctive and not descriptive.
  3. Publication of the application in the Patent Office Bulletin.
  4. Three-month opposition period. Owners of earlier marks may file an opposition during this period.
  5. Decision and protection fee. Once the fee has been paid, the office issues a certificate of protection.

An opposition significantly extends the proceedings, so checking trade mark databases before applying is the cheapest way to avoid losing the application fee.

EU trade mark registration: how much does it cost?

An EU trade mark is registered with the EUIPO in Alicante and provides protection in all EU countries through a single application. EUIPO fees are several times higher than national fees and are not yet included in our index, so we do not provide an amount here: check the office’s current price list before applying.

When should you choose an EU rather than a national trade mark? When the company sells or plans to sell in several EU countries, for example through an online shop. If you operate only in Poland, a national trade mark costing approximately PLN 890 will usually suffice, and an international application can be submitted later. How can you avoid overpaying for trade mark registration?

  • Apply online. An electronic application is cheaper: PLN 400 instead of PLN 450.
  • Choose only the classes you need. Each additional class increases the fee, and a mark that is not used for 5 years may be lost.
  • Check trade mark databases before applying. The UPRP and EUIPO search tools are free and can identify obvious conflicts.
  • Ask the patent attorney for a fixed quote that includes responses to any requests from the office. The fee of PLN 1,250 usually covers only the application itself.
  • Secure the rights to the logo in your agreement with the graphic designer before applying to register a figurative mark containing word elements.

Trade mark registration and setting up a business: which should come first?

It is worth applying to register a trade mark as early as possible, ideally before the name appears on signs, the website and packaging. Registering a business with CEIDG or KRS does not protect its name as a trade mark: two companies with similar names can operate alongside each other until one obtains a protection right.
