Is an energy performance certificate compulsory?
An energy performance certificate has been compulsory when selling or renting out a flat or house since 28 April 2023. The owner provides it to the buyer or tenant, and when a property is sold, the notary records this in the deed. The requirement also applies to adverts: a property sale or rental advert should include information about its energy performance if a certificate has been prepared.
A certificate is not required when a flat is transferred as a gift or inheritance, or when you rent out a room rather than the entire property. The regulations provide for penalties if a certificate is not supplied, but in disputed cases, consult a notary or lawyer, as the details depend on the type of agreement.
Who is exempt from the energy performance certificate requirement?
Exemptions from the energy performance certificate requirement include listed buildings, residential buildings used for less than four months a year, such as summer houses, detached buildings with a usable floor area below 50 m², places of worship and industrial buildings with low energy demand. A typical flat in a block or year-round house does not qualify for these exemptions.
What is required to issue an energy performance certificate?

Cheap does not necessarily mean poor quality, but check three things: whether the assessor is listed in the central register, whether the certificate will be entered in the register, for which you will receive a number, and how the required inspection will be carried out.
You can obtain the cheapest energy performance certificate if you have a complete set of documents and do not need it by tomorrow. If the homeowners’ association already has a certificate for the entire building, ask the property manager, as this may reduce the price for your flat.
How long is an energy performance certificate valid?
An energy performance certificate is valid for 10 years from the date it is prepared. It expires sooner if alterations or renovations change the building’s energy performance, for example after replacing the heat source or insulating the building. With a cost of about PLN 250, the expense is spread over an entire decade of sales and rentals.
What does an energy performance certificate contain and how do you read it?
An energy performance certificate primarily shows annual energy demand in kilowatt-hours per square metre of floor area. The three most important indicators are:
- EU (usable energy): the amount of energy required for heating and hot water, regardless of the heat source. It reflects the quality of the walls, windows and ventilation.
- EK (final energy): the amount of energy that must actually be purchased after accounting for the efficiency of the boiler or district heating substation. This figure is the closest to actual bills.
- EP (primary energy): an environmental indicator compared against regulatory requirements for new buildings.
The lower the values, the lower the running costs. The certificate also states the proportion of renewable energy, CO₂ emissions and recommendations for improvements. For a buyer, it is a quick way to compare two flats, one in a prefabricated concrete block and one in a new building: the difference in EK translates directly into heating costs over the years.
An energy performance certificate is neither a technical condition assessment nor a valuation. It will not tell you whether the electrical installation is safe or how much the flat is worth. When buying a property, it should therefore be treated as one of several documents, alongside the land and mortgage register, certificates from the housing co-operative and, where applicable, a valuation report.
