When buying a flat or plot, the notarial fee increases with the property's value, while tax and court fees are added to the bill.

There is no single price list for notaries. A notary charges a fee for each service, with the upper limit set by a regulation of the Minister of Justice. For property transactions, this limit depends on the value of what you are buying or transferring. VAT and fees for copies of the notarial deed are added, as are tax and court fees when buying property. The notary collects these amounts but passes them on to the relevant authorities. Below, we compare the cost of the most common visits to a notary’s office based on public price lists and guides.

How much do the most common notarial services cost?

First, an overview. Prices differ by orders of magnitude: a simple declaration costs as much as a meal, while a deed concerning a flat can cost several thousand PLN.

The cheapest services are those with a fixed fee that does not depend on any value: a power of attorney, a will or a declaration rejecting an inheritance. The most expensive are those involving the transfer of property ownership: a sale, gift or dissolution of joint ownership. In these cases, the fee is calculated based on the value of the flat or plot.

How much does a notary cost when buying a flat or plot?

For a property sale agreement, the maximum notarial fee depends on its value and increases progressively: each value bracket has a fixed amount plus a small percentage of the excess. For a typical plot or a mid-priced flat, the base maximum fee is around PLN 1,000, with an additional charge based on the excess value, plus VAT. For comparison, a typical flat in Poland currently costs around PLN 470,000, and in Warsaw PLN 755,797, so the difference in notarial fees between a flat in a smaller town and one in the capital is noticeable. We do not list the fee thresholds here because they are the figures most likely to change and the easiest to get wrong. The safest option is to ask the notary’s office for a cost calculation before making an appointment. The notary will calculate it based on the price stated in the agreement.

For agricultural land, the fee may be higher. If the National Support Centre for Agriculture has a right of first refusal, two agreements are required, one conditional and one transferring ownership, which means two fees. The same rules apply when buying a house as when buying a flat: the property’s value determines the fee.

What else do you pay at the notary’s office when buying property?

The notarial fee itself is often the smaller part of the bill. When drawing up the deed, the notary also collects:

  • Tax on civil law transactions (PCC). The buyer pays it on the secondary market, and it is calculated as a percentage of the property’s value, so it is usually the largest item for more expensive flats. There is no PCC when buying from a developer because VAT is already included in the price. Some first-time buyers may be exempt from PCC: ask the notary whether this applies to you.
  • Court fees for the land and mortgage register. A fixed court fee is charged for registering ownership. If a new register must be opened, an additional PLN 100 is charged for opening it. With a mortgage, a separate fee is charged for registering the mortgage.
  • Copies of the deed. Each party and the bank receive their own copy, with a fee charged per page.

Therefore, when asking ‘how much does a notary cost when buying a flat?’, it is worth requesting an itemised breakdown of all these charges. Notary’s offices usually send one by e-mail before the deed is signed.

How much does a notary cost when transferring a flat as a gift?

According to price lists and guides, gifting a flat most often costs a total of PLN 3,050, with half of the sources falling within the range of PLN 2,350 ‑ 4,050. The variation results from the flat’s value: the fee for a gift is calculated in much the same way as for a sale. For a gift to an immediate family member, such as a spouse, child, parent or sibling, the maximum fee is reduced by half, while additional copies of the deed cost around PLN 375. For small gifts of low value, the fee is nominal, around PLN 100.

A recipient who is an immediate family member is usually exempt from gift tax, but only if the gift is reported to the tax office by the deadline. When the agreement is concluded before a notary, the notary’s office usually submits the notification.

If a property has several owners and you want to divide it, an alternative is termination of co-ownership. At a notary’s office, the fee also depends on the value, with price lists indicating around PLN 2,900. In court, a fixed application fee applies.

How much do a will and inheritance proceedings before a notary cost?

A notarised will is one of the cheapest notarial services, costing around PLN 125, regardless of whether you are leaving someone a flat or savings. A will containing a specific legacy or disinheritance may cost more. If the notary visits your home or hospital, a travel fee is added.

How much do a power of attorney, marital property agreement and occasional lease cost?

A notarised power of attorney costs around PLN 65. A power of attorney for a single transaction is cheaper than a general one or one authorising the sale of property. If it is later submitted to an authority, a stamp duty of PLN 17 is added.

A marital property agreement costs around PLN 470 according to price lists, typically PLN 440 ‑ 545. It is worth considering before getting married or before one spouse starts a business.

An occasional lease requires the tenant to make a declaration of voluntary submission to enforcement in the form of a notarial deed. It most often costs PLN 480.60. Regulations link the maximum fee to the minimum wage, so prices are very similar between notary’s offices. If the tenant is a foreign national and a sworn translator is required, around PLN 350 must be added. The landlord usually pays the cost, but the parties may agree otherwise.

Certifications of signatures, copies as true copies of originals or dates are the simplest notarial services and have the lowest fees. We do not yet include them as separate services in the index, so we do not provide prices.

How can you avoid overpaying a notary?

  • Ask about the price before your visit. The maximum fee is an upper limit, not a mandatory price. For large transactions, notary’s offices often charge less than the maximum.
  • Compare two or three notary’s offices. For a flat, the difference in fees can exceed the entire cost of another notarial service.
  • Agree who will pay. In a sale, the buyer customarily pays, but this is a matter for agreement between the parties. For a gift, the recipient usually pays.
  • Prepare the documents in advance. Missing certificates or an extract from the land and mortgage register will mean postponing the appointment. For a sale, an energy performance certificate will also be useful, while a mortgage requires a valuation report.
