Among the 14 municipalities with at least 50 transactions over 24 months, the highest medians are in: Warsaw (855 PLN/m²), Wiązowna municipality (gmina) (200 PLN/m²), Wasilków (195 PLN/m²). The lowest are in: Turek municipality (gmina) (45 PLN/m²), Piotrków Kujawski (52 PLN/m²), Ciechanów municipality (gmina) (81 PLN/m²). What counts as a plot with development conditions?
A plot not covered by a local plan, for which a planning conditions decision (WZ) has been issued, with an area of 300 to 5000 m², sold in its entirety on the open market. We obtain information about the decision from the Property Price Register.
What are planning conditions (WZ)?
This is an administrative decision issued by the municipality head, mayor or city mayor that specifies what may be built on a plot and how, when no local development plan applies. It is issued, among other cases, when at least one neighbouring plot accessible from the same road has been developed in a similar way, known as the good-neighbour principle, the plot has access to a public road and sufficient utilities. Anyone may apply for a zoning decision, including someone who does not own the plot.
What is the difference between a plot with planning permission (WZ) and one covered by a local plan?
A local development plan is an act of local law binding on everyone in a given area, while a development conditions decision applies to one plot and one project. For a plot covered by a plan, its designated use is certain. For a plot with a development conditions decision, the decision is binding only within its scope, and different decisions may be issued for neighbouring plots. This is why plots with development conditions decisions can be cheaper than building plots covered by a plan.
How does the planning reform change planning permission conditions?
The 2023 reform introduced general municipal plans. Once a municipality adopts a general plan, planning permission is issued in accordance with it (for new development, mainly in development completion areas), and decisions issued under the new rules have limited validity (5 years) instead of remaining valid indefinitely. Before buying, check with the municipal office whether the general plan is already in force and what it provides for the plot.
What affects the price of a plot with development conditions?
As with other plots: location, access, utilities, shape and size. Other factors include the terms of the decision (the type and parameters of the development and whether it concerns a detached house) and whether the decision is final. Cautious buyers also ask whether the municipality is preparing a plan that would change the designated use of the land.
What taxes apply when buying a plot with planning permission conditions?
A plot covered by a planning conditions decision is treated as building land for VAT purposes, so a sale by a company registered for VAT is subject to 23% VAT, with no tax on civil-law transactions (PCC) payable. When buying from a private individual, the buyer pays 2% tax on civil-law transactions (PCC). Notary fees plus VAT and the court fee for registration in the land and mortgage register also apply.
Where does the data on plots with planning permission prices come from?
From the Property Price Register (RCN, Polish official register of real-estate transactions), maintained by county authorities and city mayors based on notarial deeds, with data made available by the Head Office of Geodesy and Cartography. We use data from 380 counties and city registers. These are contract prices, not asking prices, and exclude details of the parties to the transactions.
What is the difference between the transaction price and the asking price?
The asking price is the amount in the listing that the seller would like to receive. The transaction price is the amount recorded in the notarial deed, for which the property actually changed hands. Listing prices can be higher due to room for negotiation and properties that do not sell, so we show transaction prices only, as a median: half of the transactions were cheaper and half were more expensive.
How often do we update the data?
Every month, we retrieve new transactions from the register and recalculate all figures (last updated 5 October 2026). County offices enter notarial deeds in the register with a delay, so the latest complete month in the data is November 2025.
